Terms of use

These terms govern the use of Soda Performance, a service of Soda Studios AG, Hohlstrasse 402, 8048 Zürich, Switzerland ("we"). By starting an analysis or creating an account you accept them.
1. The service
Soda Performance analyses websites and brands: SEO, page speed, uptime and SSL, search rankings, backlinks, Google Business Profiles and the answers of AI assistants. The service is aimed at businesses and professionals.
The service is in early access. We develop it further and may change, add or remove features. Features described as "coming soon" are planned; you have no claim to them or to a release date.
2. Your account
Give correct details when you register, keep your sign-in details confidential and tell us if you suspect that someone else uses your account. You are responsible for what happens under your account and for the people you give access to your workspace.
3. Acceptable use
- Only use the service for lawful purposes and for websites and brands you have a legitimate interest in analysing.
- Do not use the service to overload, attack or disrupt websites of others.
- Do not circumvent limits, access the service by automated means we have not provided, or resell it without our consent.
- Do not enter prompts, keywords or other content that is unlawful or infringes the rights of others.
We may suspend or close accounts that breach these terms.
4. Prices and payment
The service is free of charge during early access. The prices shown on the website are the planned prices of the paid plans; they are in euros and exclude value added tax. We will tell you before paid plans start, and you are not charged unless you choose a plan. Once paid plans exist, they are billed monthly in advance and can be cancelled to the end of the month paid for.
5. Data from third parties and AI answers
The analyses rely on data from third parties such as search engines, Google Business Profiles, data providers and AI assistants. We do not check this data and cannot guarantee that it is correct, complete or current. Rankings, scores and recommendations are estimates.
Answers of AI assistants are reproduced as the assistants gave them. They can be wrong or outdated, they do not reflect our opinion, and we are not responsible for their content. Do not rely on them as statements of fact about a company or a person.
We do not promise a particular result, such as better rankings or more mentions.
6. Availability and monitoring
We aim for a reliable service but do not guarantee uninterrupted availability. Monitoring and alerts for uptime, SSL certificates and indexability are an aid. They can be delayed or fail and do not replace your own monitoring of critical systems.
7. Your content
The data you enter remains yours. You allow us to process it to provide the service. How we handle personal data is described in the privacy policy.
8. Our rights
The application, its design and its texts belong to us or our licensors. You may use the service and its results for your own business and that of your clients.
9. Liability
We are liable without limit for damage caused intentionally or by gross negligence, and where the law does not allow liability to be limited. Beyond that, our liability is excluded as far as the law permits, in particular for indirect damage, lost profit, lost data, missed alerts and decisions taken on the basis of the analyses.
10. Ending the use
You can stop using the service at any time and ask us to delete your account by writing to hello@soda.today. We may end the service or your access with reasonable notice, and without notice if you breach these terms.
11. Changes to these terms
We may change these terms. We tell registered users about material changes by email or in the application before they take effect. If you continue to use the service afterwards, the new terms apply.
12. Law and jurisdiction
Swiss law applies, excluding its conflict-of-law rules. The courts of Zürich, Switzerland, have exclusive jurisdiction, unless mandatory law provides otherwise.
